An Advisory Centre on International Investment Law

CCSI has prepared “Securing Adequate Legal Defense in Proceedings Under International Investment Agreements: A Scoping Study” on behalf of the Ministry of Foreign Affairs of the Netherlands. This study evaluates the challenges States face in securing legal assistance in negotiations of and dispute settlement proceedings under international investment agreements, and the desirability and feasibility of addressing such challenges in a multilateral process or institution, such as an Advisory Center on International Investment Law.

Karl Sauvant also prepared a paper on the idea of an Advisory Centre on International Law (ACIIL); this paper begins with a brief review of the rise of international investment disputes and the costs of such disputes and outlines the principal characteristics of the Advisory Centre on WTO Law, as a precedent for an ACIIL. It then focuses on the possible key features of an ACIIL, namely the potential beneficiaries, the possible range of services it could provide, its governance, and its financing.
