Cuba’s New Foreign Investment Law: What Does the Future Hold?

The Columbia Center on Sustainable Investment (CCSI) and Columbia Law School Latino/a Law Students Association (CLS LaLSA) co-sponsored a talk by Rafael Cox Alomar from the University of the District of Columbia, David A. Clarke School of Law. The talk included an updated synopsis of where the U.S. – Cuba bilateral negotiations currently stand, a briefing on Cuba’s current economic outlook and current FDI inflows, and a discussion on the more salient elements of Cuba’s new foreign investment legislation – addressing not just the technical provisions of the statute, but also its procedural infirmities from the vantage point of transparency (or lack thereof). The discussion touched upon the Cuban Bilateral Investment Treaties – their basic safeguards and dispute settlement mechanisms and on the strengths, weaknesses, opportunities and threats besieging Cuba’s institutional re-engineering.
